5 Laguna de la Paz Hmewners Assciatin Landscape Plicies and Guidelines 1. Frnt Yard Mdificatins: Written plans, including drawings, must be submitted fr written apprval t the Landscape Cmmittee PRIOR TO any additins r mdificatin. Plans must include: Descriptin f any shrubs targeted fr remval (HOA will remve shrubs, hmewner must remve grass). Descriptin f any prpsed new shrubbery, grund cver, decrative sil r rcks r planting bed brders. Descriptin f irrigatin plan. Hmewner may nt cmprmise existing lawn irrigatin grid. Request fr any change in grading r elevatin (munds). Cntractr name and license number, if applicable. Estimated time fr start-t-finish f prject. 30 days maximum. Apprval frm the Architectural Cmmittee fr any nn-grwing decrative items, such as funtains, pttery, sculptures, etc. Hmewner must meet with the landscape cmmittee in persn t discuss their frnt yard mdificatin applicatin giving the Landscape Cmmittee the pprtunity t ask questins abut the prpsed mdificatins and make changes, if necessary. Please nte that all mdificatins t frnt yard landscaping must cmply with the prcesses utlined in this dcument as well as Sectin 2.2 f the Rules and Regulatins. Additinally, hmewners requesting mdificatins must bear all cst assciated with the prject. The Assciatin s irrigatin technicians must be used t make any necessary irrigatin mdificatins. The irrigatin wrk must take place after nrmal wrk hurs at the hmewner s expense. The Assciatin will cntinue t replace any dead plants at a custmary cst. 2. Cmmn Area Damage: The cst f any and all repairs t the cmmn area landscaping, including the frnt yards f hmes, resulting frm individual hmewner-initiated prperty imprvements r mdificatins, r hmewner negligence, shall be brne by that same hmewner. The repairs required t restre the cmmn area shall be made exclusively by the Laguna de la Paz Hmewners Assciatin cntracted landscape cmpany using the cntracted labr and material rates. The invlved hmewners shall repay Laguna de la Paz Hmewners Assciatin fr the full cst f these repairs. 3. Hmewner Frnt Yard Maintenance: All hmewners wh chse t maintain their frnt yard landscaping themselves, except the lawn area, and/r plan t mdify the planting beds and shrubbery must adhere t Sectin 2.2 f the Rules and Regulatins in additin t the fllwing rules as prescribed by the Laguna de la Paz Hmewners Assciatin: Keep all shrubs trimmed t a size and shape cnsistent with the Assciatin maintained hmes in the cmplex. Adpted by the Bard f Directrs

6 Keep planting beds free f weeds and debris. Plant ONLY shrubs cntained n the list f Apprved Shrubs prvided by the Landscape Cmmittee. Exceptin: sme existing shrubbery was in place prir t the adptin f the Apprved Shrubs list and thse shrubs remain an acceptable ptin if replacements are necessary. Plant ONLY seasnal/annual flwers that are amng the variety f the seasnal/annual flwers planted by the HOA. Use ONLY decrative grund cver, rck, r dirt apprved in advance by the Landscape Cmmittee. Mnitr irrigatin t ensure prper cverage and reprt any breaks r malfunctins t the HOA Management Office lcated adjacent t the clubhuse. NO NEW TREES will be apprved t plant in any shrubbery bed. Failure t fllw these rules may result in a reminder and, if necessary, actin by the HOA landscape cntractr t bring the yard int cmpliance. The hmewner in questin will then be billed fr the additinal wrk. 4. Rear and Side Yard Guidelines: N vegetatin (tree limbs, palm frnds, vines) shall make cntact with yur rf r yur neighbrs rf. N large trees r shrubs shall be planted in yur side and/r rear yard that may result in damage t any hme r cmmn area walls. Any vegetatin that impedes the HOA s respnsibility f maintenance t the exterir f any hme is prhibited. N large trees such as Tamarisk, Eucalyptus, r any ther tree with evasive rts, that culd be destructive t any hme r cmmn area wall, shall be planted in rear yards, side yards, r near the cmmn wall. Nise created by blwing vegetatin, which disturbs yur neighbrs, shall nt be permitted. Any vegetatin that bstructs, impairs r therwise unreasnably interferes with any Lake r Muntain View Line, shall nt be permitted (Eighth Amendment t CC&R s, View Preservatin). 5. Planting f Shrubs and Trees in Cmmn Area Near Pny Walls: When existing shrubs r trees in the cmmn area adjacent t pny walls, (which are maintained by the HOA), are remved fr any reasn, NO NEW SHRUBS OR TREES WILL BE REPLANTED IN THAT LOCATION. Adjacent shall be defined fr purpses f this plicy as within 15 feet f the pny wall. Any exceptins t this rule shall be apprved in writing by the LDLP Landscape Cmmittee and shall invlve nly drught-tlerant native planting. 6. View Preservatin: Article 9 f the CC & R s applies t hmewner s tree and shrubs, nt the cmmn area landscaping. Adpted by the Bard f Directrs
