4 1 Intrductin Harmnized standards fr Sanitary Appliances have been available fr sme time. CE marking f cnstructin prducts started with the Cnstructin Prducts Directive (CPD) 89/106 EC. This directive was replaced by 305/2011 EC Cnstructin Prducts Regulatin (CPR) in July The intrductin f the CPR legislatin brught with it a new legal framewrk mandating CE marking fr cmpliant prducts and the supply f Declaratin f Perfrmance (DP) dcuments when placing cmpliant prducts n the market. The harmnized standards available at the present time may nt shw the actual legal situatin accrding t the Cnstructin Prducts Regulatin (CPR). Nevertheless, the prducts when placed n the market must fllw the latest legal requirements detailed frm the Eurpean Cmmissin (EC). It is nly permissible t use harmnized standards nly after the citatin f the standards in the Eurpean Official Jurnal [OJEU] (fllwed by the citatin in natinal fficial Jurnals). Currently the harmnized standards cited in the OJEU are reprting lder prduct CE marking details, requesting a Declaratin f Cnfrmity (DC), while e.g. the revised standards, still waiting fr citatin in the OJEU, include the reference t the Declaratin f Perfrmance (DP) in accrdance with the CPR. This situatin can easily ccur due t time delays between the publicatin f a regulatin and the necessary revisin f the underlying standards. This dcument has the aim t shw the current CPR requirements and examples fr DP and CE marking prcedure f sanitary appliances. This guide is t help everyne t understand the actual legal requirements in terms f Declaratin f Perfrmance and CE marking that must be used fr sanitary appliances. 2 Scpe This dcument is primary guidance and shws instructins, explanatins and examples fr bth preparatin f declaratins f perfrmance and CE marking in accrdance with 305/2011 EC. The guidance is especially fr harmnized standards f CEN/TC 163 e.g. EN 997, EN 12764, EN 13310, EN 13407, EN 14055, EN 14296, EN 14428, EN 14516, EN 14527, EN and EN Prducts cvered by these harmnised standards and therefre the CPR are WCs and WC suites, whirlpl baths, kitchen sinks, wall-hung urinals, WC and urinals flushing cisterns, cmmunal washing trughs, shwer enclsures, baths fr dmestic purpses, shwer trays fr dmestic purpses, bidets and wash basins. Functinal requirements and test methds 4 General This dcument is a guidance paper fr prducts cmplying with harmnized standards f CEN/TC 163. The basis fr this guidance are the requirements laid ut including and specific delegated acts f the CPR. The EC 305/2011 Cnstructin Prducts Regulatin (CPR) lays dwn harmnized rules fr marking cnstructin prducts in the EU. The Regulatin prvides a cmmn technical language t assess the perfrmance f cnstructin prducts. It ensures that reliable infrmatin is available t manufacturers, public authrities, market surveillance and cnsumers etc., s they can cmpare the perfrmance f prducts frm different manufacturers in different cuntries. The Declaratin f Perfrmance (DP) is a new key part f the CPR. It prvides infrmatin t the market f the perfrmance f a prduct. Each cnstructin prduct cvered by an Eurpean harmnized standard r fr which a Eurpean Technical Assessment has been issued, needs such a DP and has t be CE marked. This helps t increase transparency f infrmatin cncerning the prduct in the market. All EU cuntries are bliged t allw the selling f cnstructin prducts bearing the CE mark. This means that public authrities cannt ask fr any additinal marks r certificates, r additinal testing. Therefre, manufacturers are able t trade their prducts in any cuntry f the Eurpean Internal Market with the same dcumentatin and assessed prduct perfrmance. In sme cases, an EU cuntry may have lcal regulatins that d nt allw the installatin f sme CE marked prducts despite the fact that they can legally be placed n the market. Page 6 / 48

7 The affixing f the CE marking t a prduct means that the manufacturer is assuring that the perfrmance f the sld prduct is the same as what was declared and indeed that it is fit fr purpse. The CE marking indicates that a prduct is in accrdance with the requirements f the CPR. With the CE marking f a prduct, the respnsible persn declares, that: the crrespnding cnfrmity assessment prcedures were carried ut and the prduct is subject t all applicable Cmmunity regulatins. CE marking shall be the nly marking which attests cnfrmity f the cnstructin prduct with the declared perfrmance in relatin t the essential characteristics, cvered by relevant harmnised standard. Other markings e.g. trade marks may be used, prvided that they help t imprve the prtectin f users f cnstructin prducts and are nt cvered by existing Eurpean Unin harmnisatin legislatin, but nly n cnditin that the visibility and legibility f the CE marking are nt reduced, and prvided that such marks are nt likely t deceive third parties as t the meaning and frm f the CE marking. Member States cannt impse any additinal requirement at natinal, reginal r lcal level n cnstructin prducts that bear CE marking. Member States are allwed t select necessary prperties by means f requirements n build level. Hence nt all CE marked prducts culd be installed all ver Eurpe. The frmat f the abve mentined Declaratin f Perfrmance (DP) is defined in the CPR (EC 305/2011; Annex III). Further definitins fr the preparatin f DPs as well as an amended template fr the DP were intrduced with EC 574/2014. All language versins f EC 574/2014 can be accessed thrugh the fllwing link: 5 Declaratin f Perfrmance The declaratin f perfrmance shall express the perfrmance f cnstructin prducts in relatin t the essential characteristics f thse prducts in accrdance with the relevant harmnized Eurpean Standard. In case f, e.g. a dealer r a whlesaler distributing a prduct under his wn brand (private label), the respnsibility fr the CE-marking prcedure will be passed t the prduct wner. In this case the prduct wner is the whlesaler r dealer as they have taken the respnsibility by placing the prduct n the market under their wn label / brand as if they are a manufacturer. A cpy f the DP f each prduct which is made available n the market shall be supplied either in paper frm r by electrnic means. Cmmn practice is t distribute DP dcuments via manufacturers websites The mdel f the DP is prvided in Annex III f the Regulatin (EU) N. 305/2011. In accrdance with this Regulatin, the DP shall cntain, in particular, the fllwing infrmatin: Page 7 / 48

8 The reference f the prduct type fr which the declaratin f perfrmance has been drawn up; All prducts cvered by a single standard are deemed t be the same prduct type e.g. WC suite r pan, flushing cistern, urinal, wash basin, bidet, bath shwer enclsure shwer tray, cmmunal washing trugh and kitchen sink. Fr sanitary appliances all prducts must be ne f the 11 fr mentined types. Any ne type can cver lists f multiple prducts that have nly t satisfy the same Essential Characteristics. the Assessment, Verificatin and Cnstancy f Perfrmance (AVCP) system r systems f the cnstructin prduct, as set ut in Annex V f the CPR; Sanitary Appliances are set at AVCP system level 4 accrding t mandate M/110 the reference number and date f issue f the harmnized standard which has been used fr the assessment f each Essential Characteristic; E.g. EN 997: 2017 E.g. EN A1: 2015 The nly applicable prduct standard fr use are thse that are cited in the OJEU. where applicable, the reference number f the Specific Technical Dcumentatin used and the requirements with which the manufacturer claims the prduct cmplies. The DP shall in additin cntain: the intended use r uses fr the cnstructin prduct, in accrdance with the applicable harmnized technical specificatin; Persnal hygiene r PH Preparatin f fd, Washing f dishes and Drainage f waste water, r PWD (kitchen sinks nly) the list f Essential Characteristics, as determined in the harmnized technical specificatin fr the declared intended use r uses; see table ZA1 in annexes ZA f harmnized technical specificatin (e.g. prduct standards) the perfrmance f at least ne f the essential Characteristics f the cnstructin prduct, relevant fr the declared intended use r uses; Cmmn practice fr Sanitary Appliances is t assess and declare all essential characteristics. Abbreviatins f the essential characteristics are defined in the cited prduct standard(s) where applicable, the perfrmance f the cnstructin prduct, by levels r classes, r in a descriptin, if necessary based n a calculatin in relatin t its Essential Characteristics determined in accrdance with the Cmmissin determinatin regarding thse Essential Characteristics fr which the manufacturer shall declare the perfrmance f the prduct when it is placed n the market r the Cmmissin determinatin Page 8 / 48

In sme cases, where prduct standards were cited under CPD, classes may be used but this will be a temprary situatin that gets reslved with the publicatin and citatin f newer harmnized prduct standards under the CPR. the perfrmance f thse Essential Characteristics f the cnstructin prduct which are related t the intended use r uses, taking int cnsideratin the prvisins in relatin t the intended use r uses where the manufacturer intends the prduct t be made available n the market; Nt all essential characteristics are mandated in all EU member states. The essential characteristics f a prduct that are mandated in any member state shall be assessed and declared fr the market. Cmmn practice fr Sanitary Appliances is t assess and declare all essential characteristics. fr the listed Essential Characteristics fr which n perfrmance is declared, the letters NPD (N Perfrmance Determined) were used. Cmmn practice fr Sanitary Appliances is t assess and declare all essential characteristics. Regarding the supply f the DP, Article 7 f the Regulatin (EU) N. 305/2011 applies. The CPR permits the distributin f the DP n websites f the manufacturer r agent by means f the regulatin: COMMISSION DELEGATED REGULATION (EU) N 157/2014 f 30 Octber 2013 n the cnditins fr making a declaratin f perfrmance n cnstructin prducts available n a website. 15 6 Guide fr CE marking f Sanitary Appliances Using the framewrk f the Cnstructin Prducts Regulatin (CPR), Where prducts are assessed using harmnised standards they are required t carry a CE mark/label which in turn is supprted by a Declaratin f Perfrmance (DP) detailing the perfrmance f the prduct t the Basic Requirements fr Cnstructin Wrks (BRCW) als cmmnly knwn as essential characteristics. Sanitary appliances, when assessed under the apprpriate harmnised standards t demnstrate cmpliance with the CPR, has a number f characteristics that must be validated. With this in mind and the need t prvide labelling in the language f cuntry f destinatin, a simplified cding methd has been develped t aid easy checking and verificatin by authrities f the CE label placed n a sanitary appliances prduct r packaging. A full system f simplified abbreviatin cdes has been develped fr Sanitary Appliances and these are fully checked and supprted by the Eurpean Cmmissin as suitable methds t detail prduct perfrmance n CE labels. This is als the case where the standards were previusly cited under the CPD as declaratins given under the CPD are still valid under the CPR until they are replaced by newly cited prduct standards. The CE marking indicates that a cnstructin prduct is in cnfrmity with its declared perfrmance and shall include the fllwing infrmatin: The CPR demands a specific set f data t be included n the CE label name r identifying mark f the manufacturer A name r identifying mark f the manufacturer shall be given r the name f the manufacturer in the EEA r his authrized appinted deputy in the EEA. registered address f the manufacturer r an address which allws the cnsumer t get int cntact with the manufacturer. Manufacturers shall include the name and the registered address f the manufacturer, r an identifying mark which easily allws the identificatin f the name and address f the manufacturer r a pst bx address r a web address (as lng as the web address leads t the details the full pstal address f the manufacturer) is sufficient. 16 the last tw digits f the year in which the marking was first affixed Manufacturers are bliged t include the last tw digits f the year f the CE-marking which culd refer t: the year in which the initial type testing was carried ut, as the first reference f the attestatin f perfrmance f the prduct r the actual year, when factry prductin cntrl has cnfirmed the accrdance t the CPR as a cntinual and regular prcess based n AVCP as described in Annex ZA f the relevant standard. the unique identificatin cde f the prduct-type This cde shall be the unique identificatin cde f the prduct type withut any ambiguity which will link the CE marking t the declaratin f perfrmance and the declared perfrmance. This be culd be a part cde r an SKU (Stck Keeping Unit) number cde r a subset f these cdes that describe the prduct and can be related t the infrmatin cntained n the DP e.g. this culd describe the prduct withut a specific clur cde. XX.XXX.YY where YY culd be e.g. a clur ptin r ther additinal feature nt related t the harmnized prduct standard r perfrmance f the prduct in case XX.XXX wuld be sufficient. the reference number f the declaratin f perfrmance will als have t be included In case the unique identificatin cde f the prduct type is nt the same as the reference number f the declaratin f perfrmance this number shall als be shwn reference t the Eurpean Standard (used t assess the prducts perfrmance) This means the reference t the harmnized standard applied t assessment f the prduct e.g. EN 997 etc. This des nt need t include the year f publicatin f the harmnized prduct standard as this infrmatin is detailed n the DP. the designatin f the prduct accrding the crrespnding Eurpean Standard The designatin cdes fully describe the perfrmance f the prduct. Characteristics are tested fr cmpliance with the applicable standard. 17 The CE marking symbl shall be in accrdance with the general principles set ut in Article 30 f Regulatin (EC) N. 765/2008. It may be fllwed by a pictgram r any ther mark ntably indicating a special risk r use. It shall be affixed visibly, legibly and indelibly in such a way: r t the prduct e.g. WC suite r wall-hung urinal t a label attached t it e.g. WC suites r wall-hung urinal Where this is nt pssible r nt warranted n accunt f the nature f the prduct, it shall be affixed r t the packaging t the accmpanying dcuments e.g. shwer enclsures This apprach is justified t guarantee the easy visibility f the CE-mark t give the maximum chance fr e.g. market surveillance fr the identificatin f the CE-marking. Cmmn practice fr Sanitary Appliances is that the CE label is placed n the prduct. When prducts are inside packaging e.g. cartn bxes that render the prduct nn-visible the CE label shall be placed n the packaging. In this case there is n further need t label the prduct inside the packaging. In case, e.g. a dealer r a whlesaler distributes a prduct under his wn brand (private label), the respnsibility fr the CE-marking prcedure will be passed t the prduct wner. In this case the prduct wner is the whlesaler r dealer as they have taken the respnsibility by placing the prduct n the market under their wn label / brand as if they are a manufacturer. 18 7 Guide t Designatins fr Sanitaryware As a principle, the Standard and the designatin f the prduct shall be given in the first line. The secnd line shall give the designatin fr the Essential Characteristics accrding the mandate and can be deleted if all characteristics have been fulfilled. The intended use f a sanitaryware prduct, in accrdance with the scpe f the relevant standard, is persnal hygiene and in case f kitchen sinks preparatin f fd, washing f dishes and drainage f waste water. NOTE 1 The intended use is als mentined in Annex ZA, Table ZA.1 f the relevant standard. The abbreviatin PH fr the intended use persnal hygiene might be used fr CE marking EXAMPLE 1 Use f full text Persnal hygiene EXAMPLE 2 Use f abbreviatin PH Sanitaryware prducts can be described with a designatin cde which includes all the fulfilled essential requirements.
